Please let us know if you wish to accept this offer within the next 7 days. If we do not hear from you, we will assume that you do not wish to transfer the domain name to us. In that instance, it will be necessary for us to defend our trademark and initiate a formal dispute.

trademark是trademark，domain是domain。
domain是先到先得，争议的前提是恶意使用。
如果无恶意使用，名称相同就可以争议，恐怕F5,QQ之类的早就横扫全球了。

如果人家有trademark在先，你再注册同样的域名，这显然就是侵权行为。
另外这和有没有使用这个域名也没关系。你去看过去的仲裁案例就知道了。
总结一句话，见好就收吧。 这封信可以看作钓鱼执法，你要谈价，就算恶意行为，对争议不利。
